The Public Relations Team Hits the Ground Running!!

First off, the Public Relations Team would like to take a few minutes to introduce themselves to all of you:

Public Relations Chairman:  Mitula Patel – Cell #818-292-2876 Email – mrpiwla@sbcglobal.net

Public Relations Liaison:      Gina Thomas Patterson, CISR - ginatpatterson@aol.com

Communications Liaison:     Wendy Pike, CPCU, CPIW - wendy_pike@yahoo.com

Education Liaison:              Kathleen Soares, CIC, AAI, AIS, CPIW, DAE - mollykat50@earthlink.net

Safety Liaison:                      Pamela Heard, CISR, CPIW – pheard@hoffmanbrown.com

Legislation Liaison:              Rebecca B. Aherne, Esq -  raherne@khklaw.com

The entire team has been given some pretty hefty goals for the coming year, and you will be hearing from them often with ideas in each of their areas for ways to get more exposure for your Association, Educational & Professional Development Opportunities, Networking within our organization, and Community Action challenges just to name a few.  You will also notice changes to the CA Council Website coming soon thanks to our Communication Liaison, Wendy Pike.

Please feel free to contact any of the team members with any questions you have.  Have a great idea you'd like to share with us?  Drop us a line anytime.

It is also the time of the year for the CWC application submissions from the California Associations for the Speak off being held at the Council Meeting on September 24, 2010.

We would love to have someone from your association and a Member at Large compete in CWC at the Council meeting this year.  Remember, anyone who has ever taken a CWC class at any time may compete.  Those who have competed in the past (except Regional winners, who must wait 3 years) are invited to compete again.  We urge you to think of your current members, and help someone out by twisting their arm a bit!  It is a very proud moment for any Association when they are represented at the Council meeting.

Attached is an application and a copy of the speak-off rules.  The rules include presenting a 3 minute speech topic to those in attendance at our California Council Meeting in September 2010.  The topic criteria has remained the same in recent years: Claims, Current P/C issues, Current L/H issues, or one of the following: Education, Legislation or Networking.

Please contact me with any questions, and let me know if you have any problems opening the attachments and we will fax them to you.  We would really like to have all of the applications back no later than September 15, 2010.

In fellowship,

Mitula Patel

Employers- Get a Severance Sign-off

Employers often use severance pay as a way to fend off possible lawsuits by departing employees. But here's the catch: If you don't require the employee to sign a waiver of all rights to sue you in exchange for the severance, you can be sued anyway. Whenever you offer severance an employee is not otherwise entitled to, be sure to get a valid release of claims--otherwise, you might just be throwing money away.

To help ensure the release will hold up in court; keep the following tips in mind:

1) Put the agreement in language the employee can understand, avoiding complicated legalese.
2) Allow the employee to consult with an attorney before signing.
3) Be sure that the release covers, but isn't limited to, any and all claims under state, federal and local law, and be specific regarding any claims you're aware of. But remember that some types of claims, such as those for unpaid wages or workers' compensation, can't be relapsed.
4) Remember that the Older Workers' Benefit Protection Act (OWBPA) imposes additional requirements for the waiver of age bias claims for workers over age 40; as does the Age Discrimination in Employment (ADEA).
